These general conditions of service ("General Conditions") regulate the service offered by Lucky R.E. srl, (“Travel&Stay”) with headquarters in Rome, Via Giuseppe Zanardelli, n. 5, 00186, VAT number no. 09722831006 through its online platform ("Platform") reachable at the site https://travelandstay.it ("Site") which allows any natural or legal person ("Buyer") to make one or more property reservations through the Platform object of the announcements published on the Platform ("Service").
Definitions
1.1 For the purposes of these General Conditions the following is meant:
"Accommodation": the property subject of the Announcement;
"Announcement": the announcement relating to the Accommodation published by Travel&Stay on the Platform for the purposes of the Booking by Buyers;
"Buyer": the natural or legal person who intends to make one or more Accommodation Reservations through the Platform;
“Contents”: the contents of the Advertisements;
"Force Majeure Event": any of the following events, involving the Seller: extraordinary events, volcanic eruptions, disasters or natural disasters, fires, wars or acts of war, hostilities or any kind of local or national emergency, invasion, observance any order or request from any port, national, provincial or public authority of any kind, government action or rule, military action, civil war, terrorism, explosion (biological, chemical, nuclear or otherwise), rebellion, riots, insurrection, strike, civil disorder (or the mere material or substantial threat or justified anticipation of any of the above events), disruption of transport services, airport closures or any such event, circumstance or emergency of an exceptional and catastrophic nature , which make it impossible or illegal (or which prevent) the Seller from making the Accommodation available to Guests;
"Payment Method": the payment method chosen by the Buyer;
"Platform": the online platform owned by Travel&Stay which allows the provision of the Service;
"Price": the price per night relating to the Accommodation, defined and entered exclusively by Travel & Stay;
"Seller": the legal person or natural person of legal age, owner or manager of one or more Accommodations who uses the Platform in order to publish or more Announcements;
1.2 The terms reported in the continuation of these General Conditions with a capital letter will have the meaning attributed to them below.

Description of service
2.1 The Platform puts Buyers in contact with Travel & Stay allowing Buyers to make one or more Accommodation Reservations.
2.2 By accessing the Service, the Buyer must enter the information requested by Travel&Stay on the Platform in order to make an Accommodation Reservation.

Reservations
3.1 The reservation takes place according to the cancellation terms set and which can be different for each published structure.

Refund Requests
4.1 If a Problem with the Stay occurs, the Buyer may send Travel&Stay a refund request ("Refund Request") no later than 5 days from the check-out date. It will be the responsibility of Travel&Stay to ascertain and evaluate the reasons underlying the refund request and proceed with the same.

Security Deposits and Damages to Accommodations
5.1 Travel&Stay may include in the description of its Advertisement whether or not a security deposit is required for the Accommodation together with the relative amount ("Security Deposit").

6. Processing of personal data
6.1 Travel&Stay guarantees the Buyer to operate in compliance with the legislation on the processing of personal data, governed by the Privacy Code pursuant to Legislative Decree no. 196/2003 and which will process the data of the Guests exclusively for the purpose of providing the Service to the Buyer.
6.2 The privacy policy is to be considered an integral and substantial part of these General Conditions and can be accessed in the Privacy section of the Site and/or Platform. The Buyer declares to have read and accept the Travel&Stay privacy policy, undertaking to comply with all the provisions contained therein.

7. Applicable law and jurisdiction
7.1 These General Conditions are governed and interpreted according to Italian law.
7.2 The Parties agree to submit to the exclusive jurisdiction and competence of the Court of Rome, in relation to any dispute or matter that arises from or is connected with these General Conditions.
